Kanawha woman claims racism

CHARLESTON - A Kanawha County woman says she was fired from her job because of her race.

Regenia Davis filed the lawsuit Sept. 29 in Kanawha Circuit Court against ADP Total Source and Ten South Management Co.

Davis says she was formerly an assistant property manager for the Vista View Apartments until she was fired July 3 by Ten South.

She adds that she was unfairly accused of improper conduct even though she had "properly, competently and diligently discharged her duties."

"The allegations of misconduct which formed the basis of the plaintiff's termination were spurious, clearly untrue and advanced by the defendant to justify the plaintiff's termination," the complaint says, "all of which allegations were also an attempt on the part of the defendant to contend that the plaintiff engaged in gross misconduct and/or insubordination."

Davis claims the real reason she was fired is because she is black.

"In fact, the reason for the termination of the plaintiff was because she was an African-American female and all other allegations of misconduct leading up to July 3 were unsupported…" the complaint says.

Davis seeks reinstatement to her position and compensatory and punitive damages.

Henry Wood III is representing the plaintiff.

Judge Louis Bloom has been assigned the case.
