Home builder named in thee more lawsuits

MARTINSBURG - A home building company in Berkeley County is the defendant in three suits filed last month, making a total of more than 30 cases filed against the business in the last six months.

Mountain State Electric, Carpets Unlimited and Jefferson Asphalt Products Company each filed suits in Berkeley Circuit Court against American Homes By United Builders. The suits combined seek more than $250,000 from American Homes.

Between September 2006 and February 2007, American Homes and owner John E. Petry have been sued for millions of dollars in more than 30 lawsuits.

The most recent suits each claim Petry breached his contract with the companies and has not paid any of the companies for work they did for him.

Attorney Christopher Presioso filed two suits -- for Carpets Unlimited and Mountain State Electric. Mountain State Electric seeks payment for labor and materials in excess of $42,147.99.

Carpets Unlimited seeks reimbursement for several flooring installations, as well as labor and materials. They seek $53,846.62.

Jefferson Asphalt Products names 12 defendants in their suit, including BB&T Bank. Filed by attorney M. Dawn Alexander, the company seeks $163,035 for money owed under the contract of all the parties.

The suit also says that Petry has admitted that companies that he is the managing member of are delinquent in payments to subcontractors and suppliers.
