Man suffered several injuries in nursing home, suit claims

CHARLESTON - A guardian for a man who received several injuries while in the care of a nursing facility has filed a suit against the health care facility where the man resided for more than a decade.

Clayton Brown filed a suit Jan. 7 in Kanawha Circuit Court against Genesis Healthcare Corporation. The suit was filed on behalf of Clarence Brown.

Clarence Brown was a resident of Marmet Health Care Center from April 27, 1996 to May 16, 2007. Clayton Brown claims that while in the care of the facility Clarence Brown suffered several personal injuries and damages.

According to the suit, Brown was admitted to Marmet Health Care Center in 1996 at the age of 46 because he suffered from dementia and his cognitive and physical skills were impaired.

The suit says Brown no longer had the awareness to be able to fully comprehend all of the elements necessary to know he had been a victim of nursing home negligence and resident rights violations.

Clayton Brown claims Clarence Brown suffered from multiple pressure sores, dehydration, malnutrition, contractures, aspiration pneumonia and infections.

In the nine-count suit, Clayton Brown claims the facility and all defendants responsible failed to provide a proper atmosphere for Clarence Brown. He claims the defendants failed to keep Clarence Brown from harm and caused him to suffer.

Clayton Brown seeks compensatory and punitive damages to cover the injuries of Clarence Brown.

Attorney Michael J. Fuller is representing Brown. The case has been assigned to Tod Kaufman.
