* The plaintiffs represent a class of people who purchased Vytorin, a medication made by the defendants. The plaintiffs claim the defendants marketed Vytorin as a superior treatment to atherosclerosis, but say there is no scientific basis for those claims. They also say the defendants suppressed information from a study showing Vytorin isn't superior to other generic simvastatins and other statins such as Lipitor and Zocor. They seek damages equal to all expenditures made purchasing Vytorin or the maximum statutory damage amounts recoverable according to the West Virginia Consumer Protection Act as well as costs, attorney fees and interests.

    All money gained from selling Vytorin should be returned to each patient. This drug was sold under false pretense. While it didn't hurt or kill anyone like VIOXX did is was still wrong for big pharma to hold information from the public and FDA. Doctors prescribe medications fully believing they will help their patient, when in fact big pharma already knows that is not the case. If more drug companies are caught doing this terrible deed maybe we'll have higher quality medicines.
