CHARLESTON - A West Virginia man has filed a suit against 47 companies, claiming he was exposed to asbestos and other harmful dusts while working on the railroad.

John Samuel Cordova filed the suit April 9 in Kanawha Circuit Court, against CSX Transportation, the successor to the Baltimore and Ohio Railroad. Cordova was employed by B&O, where he claims he worked in the vicinity of toxic materials.

According to the suit, Cordova was unaware of the dangers of the toxic dusts to which he was exposed. He now suffers from severe injuries to his respiratory system, including asbestosis, because of the exposure.

Cordova claims he suffers great pain, mental anguish; and his enjoyment of life and earning capacity are greatly reduced.

In the 10-count suit, Cordova seeks compensatory and punitive damages.

Attorney Cindy J. Kiblinger is representing Cordova. The case will be assigned to a visiting judge.

Kanawha Circuit Court case number 08-C-702
