Man says he was discriminated against on mine job

CHARLESTON - A Kanawha County man has filed a suit against a local mining company, claiming he was discriminated against because of his race and religion.
Mohamed Aboelmagd filed the suit April 14 in Kanawha Circuit Court, against Spartan Mining Company, doing business as Mammoth Coal Company.
According to the suit, Aboelmagd worked for Spartan Mining at the Mammoth Coal operation in Kanawha County on April 26, 2006.
Aboelmagd claims he was subjected to verbal harassment, including being called a "sand nigger" and a terrorist, as well as derogatory comments made about his religion.
Also, on April 9, 2007, Aboelmagd claims he was choked and otherwise assaulted and battered and subjected to verbal abuse by his supervisor, David Light.
Aboelmagd claims the actions were in violation of the West Virginia Human Rights Act.
In the seven-count suit, Aboelmagd claims he endured pain and suffering, lost wages, annoyance and inconvenience and emotional injury, all of which are permanent.
He seeks compensatory and punitive damages.
Attorney Tim Bradford is representing Aboelmagd. The case has been assigned to Judge Jennifer Bailey Walker.
