* The plaintiffs say the defendants and agents wrongfully disposed of construction fill and waste from the relocation of U.S. 35 on their property even after being notifed to stop. They say the property is now destroyed. They allege negligent trespass, willful and intentional trespass, negligence, damages for destruction of trees and vegetation. They seek compensatory and punitive damages, attorney fees, pre- and post-judgment interest, court costs and other relief as well as a mandamus directing the state to begin paying the plaintiffs for damages.
