Woman says bad nursing home care injured her

CHARLESTON – A woman claims shoddy nursing home care has left her in worse health than when she went in.

Tamorah Miller sued Genesis Healthcare Corp. and several subsidiaries doing business as Brightwood Center in Follansbee in Kanawha Circuit Court on Feb. 27.

Miller claims she was admitted to Brightwood in August 2005 at the age of 40. She remained a resident there until June 2008, the complaint says.

Miller alleges she and other residents did not get the necessary care they required while at Brightwood because of staffing and supplies shortages due to budgetary restrictions.

Miller claims the company should have been aware that there were issues at Brightwood that had resulted in residents suffering falls, pressure sores, weight loss, dehydration. She also claims residents were administered psychotropic medications and put in restraints.

The complaint does not describe what ailed Miller that required her to be admitted to Brightwood. But she claims that staff there did not provide her with adequate personal hygiene, which resulted in urinary tract infections.

Miller also claims she suffered extreme pain, suffering and mental anguish due to her treatment there.

She says staff failed to keep appropriate medical records which would have showed the alleged deterioration in her health, which she claims has been at a rate faster than the normal aging process.

The plaintiff is seeking damages, including punitive, plus legal costs.

Michael J. Fuller Jr., of Hattiesburg, Miss. is representing Miller. The case is before Kanawha Circuit Judge Paul Zakaib.
