Man says he was injured by stray concrete-mixer chute

MARTINSBURG – A Falling Waters man says a concrete-mixer truck driver was negligent after he was knocked off a wall by the chute on the truck.

Michael E. Markley Jr. filed a lawsuit March 13 in Berkeley Circuit Court against Thomas, Bennett and Hunter, Inc, a Maryland concrete supplier.

Markley claims he was standing along Grade Road in Falling Waters on April 2, 2007 as a concrete-mixer truck belonging to the defendant was operating nearby.

At some point, Markley claims that the driver of the truck caused the chute which dispenses the concrete to strike Markley, knocking him off a wall.

Markley says he was injured in the accident and has incurred $13,000 worth of medical bills. He's also suing for lost wages, pain and suffering, permanent disability and scarring and diminished capacity to enjoy life.

He seeks $75,000 in damages.

Bradley J. Reed is representing Markley. The case is before Berkeley Circuit Judge Gray Silver.
