* On Dec. 30, 2005, Letton operated on Savannah in an attempted laparoscopic Nissen fundoplication, according to the complaint. It says he lacerated her spleen, and a sponge was not removed after surgery. They accuse him of medical malpractice and battery for "intentionally touching and removing ... appendix without prior medical authorization."
