WAYNE -- A woman claims she and her minor son were severely injured after they were rear-ended while stranded in the middle of Interstate 64.

Donna Murray filed a lawsuit individually and on behalf of her minor son, Nathaniel Hatten, on July 10 in Wayne Circuit Court against Clifton F. Smith.

According to court records, Murray was driving east on Interstate 64 between mile markers 4 and 5 on the Spring Valley overpass when her vehicle suddenly malfunctioned.

Smith then rear-ended Murray's vehicle after it was disabled on the interstate, the complaint says.

Because of the accident, Murray says she and her son experienced pain, discomfort, loss of mobility and mental anguish, incurred medical bills and experienced an impaired ability to enjoy life.

"Additionally, this accident has caused an enormous financial burden for Plaintiff Donna Murray," the suit states.

Murray is seeking actual costs, plus pre-judgment interest, attorney fees and other relief.

D. Scott Bellomy of Bellomy and Turner in Huntington will be representing him. Wayne Circuit Judge Darrell Pratt will hear the case.
