Huntington ob-gyn sued again for medical malpractice

HUNTINGTON — A Huntington surgeon is being sued again for medical malpractice.

On Aug. 20, 2007, Dr. Mitchell E. Nutt, an obstetrician and gynecologist in Huntington, performed surgery on Janice Roush at St. Mary's Medical Center, according to a complaint filed Nov. 3 in Cabell Circuit Court.

During the surgery, Nutt performed a hysterectomy, salpingo-oophorectomy, closure of a vaginal enterocele, anterior colporrhaphy with graft, perivaginal repair, posterior colporrhaphy with graft, sacrospinous colposuspension and an anal sphincteroplasty.

Roush claims during the surgery Nutt implanted the Avaulta Anterior and Posterior BioSynthetic Support Systems into her body, despite not having obtained her informed consent to do so.

According to the suit, Nutt implanting the products into her body was "harmful and unwanted."

Roush claims since the surgery she has experienced significant mental and physical pain and suffering; has sustained permanent injury; permanent and substantial physical deformity; and loss of a bodily organ system.

Roush is suing for compensatory and punitive damages. Paul T. Farrell Jr. and Lawrence J. Tweel of Greene, Ketchum, Bailey, Walker, Farrell & Tweel; and J. Robert Rogers are representing her.

In October, a couple sued Nutt in a similar case.

On Aug. 6, 2007, Nutt performed surgery on Teressa Hager at St. Mary's Medical Center. He performed an anterior colporrhaphy with excision of para-vaginal scarring and a portion of a prior implanted PelviSoft graft. He also implanted an Avaulta Anterior graft.

In her case, Hager claims since the surgery she has experienced significant mental and physical pain and suffering, has sustained permanent injury, permanent and substantial physical deformity and loss of a bodily organ system. She also claims she has undergone and will likely undergo in the future corrective surgeries and has endured impaired physical relations with her husband, David Hager.

The Hagers are suing for compensatory and punitive damages for negligence and loss of consortium. Paul T. Farrell Jr. and Lawrence J. Tweel of Greene, Ketchum, Bailey, Walker, Farrell & Tweel; and J. Robert Rogers are representing them.

The Roush case has been assigned to Circuit Judge F. Jane Hustead.
