Man sues Hurricane nursing home for mother's death

WINFIELD -- A Putnam County man is suing the Teays Valley Nursing and Rehabilitation Center and Genesis Healthcare Corporation after he claims they are at fault for his mother's death.

Evelyn Frances Scott was a resident of Teays Valley Nursing and Rehabilitation Center from July 1, 2006 through April 2, 2009, according to a complaint filed Dec. 28 in Putnam Circuit Court.

Scott's son, Philip L. Scott, claims while his mother was in the nursing home she suffered urinary tract infections, pneumonia, conjunctivitis, osteomyelitis, multiple falls and a head wound that necessitated hospitalization. He claims she also suffered from inadequate nutrition and hydration.

Mr. Scott claims the defendants failed to protect his mother from avoidable accidents and failed to develop an adequate fall prevention plan. He claims his mother suffered from systemic abuse and neglect that ultimately led to her death on April 6, 2009.

Mr. Scott is seeking compensatory and punitive damages for negligence and wrongful death. He is being represented by Andrew L. Paternostro and Jeff D. Stewart of the Bell Law Firm.

The case has been assigned to Circuit Judge Phillip M. Stowers.
