CHARLESTON -- A man is suing the City of Nitro after he claims he was injured when he fell at the Nitro City Park.
On Oct. 19, 2009, Steve Cummings was fishing at Nitro City Park when he slipped and fell, according to a complaint filed Dec. 10 in Kanawha Circuit Court.
Cummings claims the defendant owed a duty to inspect the lakeside and make it safe for visitors and failed to do so.
Nitro's negligence resulted in Cummings to slip and fall at the side of the lake and receive serious injuries, according to the suit.
Cummings is seeking compensatory damages. He is being represented by Betty C. Gregory.
The case has been assigned to Circuit Judge Paul Zakaib Jr.
