Woman files suit over nursing home negligence

CHARLESTON -- A woman is suing Formation Capital, LLC, after she claims they were negligent in caring for her family member.

FC Gen Acquisition, LLC; FC Gen Acquisition Holding, LLC; FC Gen Acquisition, Inc.; Genesis Healthcare Corporation; Genesis Healthcare Holding Company II, Inc.; Genesis Health Ventures, Inc. of West Virginia; Genesis Eldercare Corporation; Genesis Eldercare Network Services, Inc.; Genesis Eldercare Network Services, Inc.; Genesis Eldercare Management Services, Inc.; Genesis Eldercare Rehabilitation Services, Inc.; Genesis Eldercare Staffing Services, Inc.; Genesis Eldercare Hospitality Services, Inc.; Glenmark Associates, Inc.; 1543 Country Club Road Manor Operations, LLC; Beth Harris; John Does 1 through 10; and Unidentified Entities 1 through 10 (as to Pierpont Center) were also named as defendants in the suit.

On Jan. 26, 2010, Hazel Brewer was admitted to Pierpont Center, according to a complaint filed Sept. 26 in Kanawha Circuit Court.

Brenda Vincent claims while Brewer was a resident at Pierpont Center, she sustained physical and emotional trauma that accelerated the deterioration of her health and physical condition beyond that caused by the normal aging process.

The defendants' actions caused Brewer to lose her personal dignity and caused her death to be preceded by extreme and unnecessary pain, degradation, anguish, otherwise unnecessary hospitalizations, disfigurement and emotional trauma, according to the suit.

Vincent claims the defendants breached their duties by failing to adequately care for Brewer.

The defendants' failures caused Brewer to suffer injuries; suffer extreme pain, suffering, mental anguish, embarrassment and fright, according to the suit.

Vincent is seeking compensatory and punitive damages. She is being represented by James B. McHugh and Michael J. Fuller Jr.

The case has been assigned to Circuit Judge Carrie Webster.
