* On May 15, Brooks was admitted to Huntington Health & Rehabilitation, where he remained until July 10. During his residency, Brooks sustained physical and emotional trauma, including pneumonia, sepsis, falls, bleeding and aspiration. Handley is seeking for the court to order and declare that no valid agreement to arbitrate exists in the mater.

* On Nov. 12, 2009, Mrs. Miller was admitted to Cabell Huntington Hospital for an exploratory laparotomy and small bowel resection to repair a small bowel fistula. During the course of the procedure, Denning lacerated the left lower lobe of Mrs. Miller's liver. Mrs. Miller died on Nov. 16, 2009. Mr. Miller is seeking compensatory damages.

* On May 26, 2010, Mrs. Holston was admitted to St. Mary's Medical Center for a right hip total arthroplasty. During her admission at the hospital she suffered a skin break down and pressure ulcers. Mr. Holston claims the skin break down and pressure ulcers contributed to Mrs. Holton's death on July 9, 2010. Mr. Holston is seeking compensatory and punitive damages.
