Couple says Ford Explorer they purchased was a lemon

CHARLESTON – A Kanawha County couple says the Ford Explorer they purchased was defective.

Shannon Bates and Sandra Jacobson of Charleston filed their complaint in Kanawha Circuit Court against Moses Ford Inc., Ford Motor Company and Bank of America.

According to the complaint, the married couple purchased the vehicle June 16, 2018, from I-77 Auto Group in Ripley for $42,196 financed with Bank of America.

The couple says the vehicle suffered major mechanical problems, including the constant leaking of fluid. They say it was out of service for repair more than six months and was presented for repairs more than three times for the same issues. Moses Ford was the dealer that attempted the repairs, according to the complaint.

They say they notified Ford of the issues and demanded a buy back, but Ford refused.

The couple seeks compensatory damages, punitive damages, court costs, attorney fees, pre- and post-judgment interests and other relief.

They are being represented by Thomas Peyton of Peyton Law Firm in Nitro. The case has been assigned to Circuit Judge Carrie Webster.
